Terms and Conditions of the online store rightstuff.eu

§1 General Provisions
- Definitions:
a) Business Days – days of the week from Monday to Friday, excluding public holidays.
b) Delivery – the act of delivering the Goods specified in the order to the Customer by the Supplier on behalf of the Seller.
c) Supplier – the entity cooperating with the Seller for the purpose of Delivery of Goods, such as a courier company.
d) Password – a sequence of letters, numbers, or other characters chosen by the Customer during Registration in the Online Store, used to secure access to the Customer’s Account.
e) Hotline – the telephone number +48 579297461, available for Customer contact with the Seller regarding information related to concluded Sales Agreements.
f) Customer – any entity using the Online Store or making a purchase from the Seller.
g) Consumer – a natural person entering into a legal transaction with the Seller not directly related to their business or professional activity.
h) Customer Account – an individual panel for each Customer, created by the Seller after Registration, allowing the Customer to use certain Online Store functionalities.
i) Buyer – any entity making a purchase from the Seller.
j) Entrepreneur – a natural person, legal person, or organizational unit without legal personality that is granted legal capacity by law, conducting business or professional activity on their own behalf, and entering into a legal transaction with the Seller directly related to that activity.
k) Terms and Conditions – this document.
l) Registration – the act of creating a Customer Account in the Online Store by the Customer in the manner specified in these Terms and Conditions.
m) Online Store – the website www.rightstuff.eu.
n) Seller – OLEG MOZHEY, ul. B. Prusa 6/75, 50-319 Wrocław, REGON: 522398369, NIP: PL8982279308, who is also the owner of the Online Store.
o) Store Website – the websites through which the Seller operates the Online Store, under the domain www.rightstuff.eu.
p) Goods – any product presented by the Seller through the Store Website, which may be the subject of a Sales Agreement.
q) Sales Agreement – a distance sales agreement concluded under these Terms and Conditions between the Buyer and the Seller.
- These Terms and Conditions define the rules of purchasing in the Online Store rightstuff.eu operated by the Seller.
- In case of problems or questions regarding the use of the Online Store, the Customer may contact the Seller.

c) by mail: ul. B. Prusa 6/75, 50-319 Wrocław - A Buyer may only be a legal or natural person with full legal capacity, or a natural person with limited legal capacity duly represented by an authorized representative.
- Deliveries are made within the territory of the Republic of Poland and to European Union countries.
- A condition for placing an order is familiarization with these Terms and Conditions and acceptance of its provisions before concluding a Sales Agreement or an electronic services agreement.
§2 Technical Requirements
- To use the services provided under these Terms and Conditions, the Customer should have:
- Internet Explorer version not older than 7.0,
- Mozilla Firefox not older than version 3.0,
- Chrome (any version), or
- Opera not older than version 2,
with JavaScript enabled.
- The Customer may consent to the use of Cookies. Details regarding the purpose of storing and accessing information via Cookies, as well as options for storage and access settings, are provided in the Privacy Policy.
§3 Electronic Services
- Through the Store Website, the Seller provides the following electronic services free of charge:
a) enabling Customers to browse the assortment of the Online Store,
b) Customer Account,
c) Newsletter subscription. - The agreement for browsing the Store assortment is concluded for a definite period and terminates when the Customer closes the Store Website.
- The Customer Account Service Agreement is concluded for an indefinite period.
- The Newsletter Service Agreement is concluded for an indefinite period.
- The Customer is obliged to use the Online Store in a manner consistent with the law and good practices, with respect for the personal rights and intellectual property rights of third parties.
- The Customer is prohibited from providing unlawful content.
§4 Sales Agreement
- Information about Goods provided on the Store Website, in particular their descriptions, technical and performance parameters, and prices, constitute an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code.
- To place an order, the Customer must complete the order form on the Store Website, selecting the Goods and providing required personal and delivery information.
- Orders may be placed 24 hours a day, 7 days a week.
- The conclusion of a Sales Agreement between the Customer and the Seller occurs upon confirmation of order acceptance by the Seller, sent to the Customer’s email address.
- The Sales Agreement is concluded in English.
§5 Prices and Payment Methods
- Prices of Goods shown on the Store Website are gross prices (including VAT) and are expressed in euro (EUR) or Polish złoty (PLN), depending on the selection.
- The total price of the Goods, including taxes, as well as delivery costs and any other charges, will be communicated to the Customer before placing the order.
- The Customer may choose from the following payment methods:
a) electronic payments through available online payment systems,
b) bank transfer,
c) payment by card. - In the event of non-payment by the Customer within 7 days of order placement, the order will be canceled.
§6 Delivery
- Delivery of Goods is limited to Poland and other EU countries.
- Delivery costs are indicated each time on the Store Website and during the ordering process.
- Delivery is carried out by courier services.
- The delivery time is up to 14 Business Days unless otherwise stated in the product description.
§7 Complaints
- The Seller is obliged to deliver Goods free from defects.
- The Seller is liable to the Customer if the Goods have a physical or legal defect (warranty).
- A complaint may be submitted by email to: [email protected] or in writing to the Seller’s address.
- The complaint should include:
a) the Customer’s contact details,
b) information about the Goods and the order,
c) description of the defect,
d) the Customer’s demand. - The Seller will respond to the complaint within 14 days of receipt.
§8 Warranty
- If the Goods are covered by a manufacturer’s or distributor’s warranty, the information is provided in the description of the Goods.
- Warranty conditions are specified in the warranty card issued by the guarantor.
§9 Liability
- The Seller shall not be liable for interruptions in the functioning of the Online Store caused by force majeure, unauthorized actions of third parties, or incompatibility of the Online Store with the Customer’s technical infrastructure.
- The Seller is not liable for delivery delays caused by the courier or customs authorities.
§10 Withdrawal from the Agreement
- In accordance with the Act of 30 May 2014 on Consumer Rights, the Buyer who is a Consumer has the right to withdraw from the Sales Agreement within 14 days without giving any reason.
- To exercise this right, the Consumer must submit a statement of withdrawal by email or in writing, as indicated in §1.4.
- The Consumer is obliged to return the Goods at their own expense within 14 days from the date of withdrawal.
- The Seller refunds the Consumer the purchase price, including delivery costs (to the extent required by law), within 14 days of receiving the returned Goods or proof of dispatch.
- Exceptions: the right of withdrawal does not apply to Goods made to the Consumer’s specification, Goods unsealed after delivery that are not suitable for return for health or hygiene reasons, and other exceptions defined by law.
§10a Returns and Refunds
- The Seller makes every effort to ensure that all Goods are as described and free from defects. If the Goods do not meet the Buyer’s expectations, they may be returned in accordance with this section and applicable law.
- Returns are accepted within 14 days from the day the Consumer receives the Goods, in line with §10 of these Terms and Conditions.
- Returned Goods must be intact, complete, in the original packaging (if applicable), and free from signs of use beyond what is necessary to establish their nature, characteristics, and functioning.
- Refunds are made within 14 calendar days from the date the Seller receives the returned Goods or proof of their dispatch – whichever occurs first.
- Refunds are issued using the same payment method as used by the Buyer, unless the Buyer expressly agrees to another method that does not incur additional costs.
- Return shipping costs are borne by the Consumer, except where the return results from the Seller’s fault (e.g., incorrect or defective Goods).
- The Seller does not accept COD (cash-on-delivery) returns.
- Goods made to order, hygiene products, and unsealed health-related items (e.g., cosmetics once opened) cannot be returned.
- In case of partial returns, only product costs are refunded; delivery costs are not refunded if the Buyer keeps at least one product from the order.
- Customs Duties and Taxes: The Seller does not cover customs duties, import taxes, or any additional fees imposed by the country of destination. These costs are the sole responsibility of the Customer.
- Refusal of Parcels: If the Customer refuses to accept delivery of the parcel or fails to settle customs duties/taxes, resulting in the return of the Goods to the Seller, the refund amount will be reduced by:
- the Seller’s actual shipping costs,
- any return fees charged by the courier, and
- any customs duties, taxes, or handling fees imposed on the Seller under EU or local laws.

§11 Personal Data Protection

§12 Final Provisions
- Sales Agreements and the use of the Online Store, including transactions with foreign entrepreneurs, are governed by Polish law, in particular:
- the Civil Code of 23 April 1964,
- the Act of 30 May 2014 on Consumer Rights,
- and other applicable EU consumer protection regulations.
- Any disputes arising between the Seller and the Customer shall be resolved by the competent court under applicable law.
- The Seller reserves the right to amend these Terms and Conditions for valid reasons, including changes in law, changes in payment or delivery methods, or technological updates. Customers will be informed of any amendments via the Store Website.
